General Billing

Usage of Handy Investor Pty Ltd products and services constitutes customer’s acceptance of Handy Investor Pty Ltd billing policy, and all customers must comply with this billing policy.

Special note regarding signed contracts: If you entered into a signed contract for your services, such as a 6 month contract, please review your contract for specific terms relating to your obligations in addition this billing policy. In the event the terms of your signed contract conflict with these terms, the signed contract will prevail.

Unless otherwise agreed in writing, all accounts are set up on a prepaid basis, and payment must be received by Handy Investor before any billable product or service is provided/activated.

Customers are required to keep a valid credit/debit card on file to charge for recurring monthly subscription fees.

Customers are responsible for keeping all credit/debit card details and contact information current.

All recurring subscriptions are automatically invoiced and charged to the credit/debit card on file.

Payment receipts are available to customers upon request.

Billing Cycle

Credit/Debit Card Billing: All credit/debit cards are automatically charged on the customer’s specific billing cycle date.

Late Fee: All past due accounts may be assessed a late fee.

Delinquent Payments: In the event any payment is 15 days past due the account may be disabled until balances are paid in full. When disabled, all access will be suspended and data will be unavailable and in some cases may be lost.

Deactivation: Once an account is delinquent 60 days, it may be cancelled due to non-payment. Once cancelled, the customer will not be able to recover any files until the account is current.

Application data may be stored for up to 90 days post-cancellation; after 90 days, application data will no longer be available. In this event, the account record and delinquent balance will be submitted to a third-party collection service.

Fees

Late Fee: Handy Investor Pty Ltd may assess a $30.00 late fee for any payment that is 15 days past due.

Chargebacks: If a customer initiates a chargeback, Handy Investor Pty Ltd may assess a $50.00 processing fee for each individual chargeback.

Collections Fee: In the event an account is submitted to a third-party collections service, a $35.00 processing fee may be assessed to the existing account balance. This fee is in addition to any other fees previously assessed on the account.

Handy Investor Pty Ltd Services

Spending Planner Services and all other Services purchased from Handy Investor must be used within the timeframe specified at the time of purchase. Specifically, unless otherwise stated at purchase. Spending Planner Services and all other Service fees are nonrefundable. In the event of cancellation, Handy Investor Pty Ltd will not prorate any portion of unused Service fees, and amounts due to Handy Investor Pty Ltd must be paid in full.

Refund Policy

Handy Investor Pty Ltd As a Spending Planner and a member of the Spending Planner’s Institute it is my aim to please, but I realise that no matter how hard I try and no matter how good I believe my product might be there is always the possibility that someone will not be happy with their experience.

Software

The software we use is provided via a small monthly access fee. Access to the software and the monthly payment can be cancelled at any time but a refund is not possible.
Consultation & Spending Plan set up

There is no refund on the initial consultation or spending plan set up fee.

Monitoring Program

There is no refund on the monthly monitoring program offered but the monthly payments can be cancelled and the service discontinued at any time after 6 months. With 30 days Written notice, see “How to Contact us” Below.

Payment Methods

Handy Investor accepts payments via credit/debit card and VISA credit/debit cards and EFT.

Subscription Billing

Invoices are generated and payments are collected in the middle of each billing period. Customer billing periods typically begin on the 15th day of the month or when the customer purchased the Handy Investor Pty Ltd Spending Plan subscription. Customers must request to cancel their subscriptions at least 10 days prior to their next billing date in order to avoid being charged on the billing date. In the event of cancellation, customers will still have access to their applications through the end of their final billing period. Handy Investor Pty Ltd will not prorate any portion of unused subscription services. All subscription fees are nonrefundable.

CANCELLATION PROCESS

Creating a Cancellation request: A request to cancel a Handy Investor Pty Ltd application must be initiated at least 10 days prior to the next invoice date. Any request to cancel a Handy Investor Pty Ltd application must be made in writing with a Handy Investor Pty Ltd representative at least 10 days prior to the next invoice date. Customers are encouraged to keep records of all communications regarding cancellation.

Simply cancelling the credit/debit card associated with a Handy Investor Pty Ltd account does not cancel the account. Handy Investor Pty Ltd will continue to treat this as an open account and the billing cycle will continue, resulting in a past due account that may be turned over to a third party collection service. It is imperative that you speak with a Handy Investor Pty Ltd representative or submit an email with receipt confirmation if you wish to initiate cancelation of your Handy Investor Pty Ltd Spending Planner account.

Finalising the Cancellation: After a request to cancel has been initiated, you must speak with a member of the cancellation team to finalise the cancellation. Cancellations will take effect on the last day of the billing period in which the cancellation was processed by the cancellation team, subject to the terms of the “Subscription Billing” paragraph above.

Cancellation of an account does not dismiss outstanding invoices or nullify previously agreed charges, such as payments for Spending Planner Services fees, charged in instalments or 6 month contract charges, portions of which may not yet have been invoiced when you cancelled. At the time of cancellation, any outstanding balance must be settled. All cancelled accounts with an outstanding balance may be turned over to a third-party collection service.

Billing Disputes

Each Handy Investor Pty Ltd customer agrees to provide Handy Investor Pty Ltd 30 days to attempt settlement of any billing dispute before disputing with any third-party credit/debit card company or bank. Should Handy Investor Pty Ltd receive a chargeback from a third-party credit/debit card company or bank on the customer’s behalf before Handy Investor Pty Ltd has been given a chance to resolve the issue, Handy Investor Pty Ltd has the right to charge the customer for its time spent in resolving such disputes and any associated fees incurred by Handy Investor, in addition to the $50 chargeback fee mentioned above. Regardless of the outcome of the chargeback, Handy Investor Pty Ltd retains the right to collect on any Services or fees that are due. Handy Investor Pty Ltd may submit any disputed amounts to a collection agency. Once a chargeback has been received, Handy Investor Pty Ltd has the right to suspend the account until the matter is resolved.

Refunds

Subscription and Service fees, including but not limited to those related to the Spending Planner Service, are nonrefundable and will not be prorated at any time.

TERMS OF ENGAGEMENT

This program has been designed to take you through the process of setting up a Spending Plan that takes the stress out of getting your bills paid on time and having money available each week to cover your household expenses. This should allow you to see where you may have been going wrong in the past and to develop new habits that empower you financially into the future. In order to achieve this, you need to be willing to work with me and be open-minded about the ideas I will be presenting to you. I am really focussed on improving your financial well-being and the very fact that you have enrolled in this program says to me that you are also ready to focus on your “money habits” and to work on getting results.

The following ‘Terms of Engagement’ summarise how we will work together.

I will act in the role of a Coach/ Mentor. I will lead you through the program and will monitor your progress. I will be totally committed to helping you create a Spending Plan that works for you and I’ll then help you adhere to that plan and make any alterations that may be required to ‘fine tune’ it to suit your needs as closely as possible.

Once you have enrolled and accepted these expectations you can be sure of my absolute commitment to your Success with Money and I will be looking for a similar commitment on your part so we complete what we start.

If you have any questions at all along the way you MUST ask me! The biggest block to making changes in your life is having an unanswered question or something you do not understand that is stopping you from moving forward. Send an e-mail and let me know if you need help.

When you email me a question I will endeavour to answer within 24 hours but if this is not possible for some reason I will answer within 2 business days at the latest. I may also refer you to other sources of information such as books or websites in order to help you and to answer your questions.

The program runs for as long as you feel is necessary, but has a minimum commitment of 6 months.

In the first stage of the program there will be some administration and set-up for you to do. You will receive personal responses to your progress. There are a number of scheduled phone calls or meetings to clarify where you are up to and what comes next.

In the second stage, you will receive a weekly e-mail from me requesting that you report your Spending Plan’s account balances to me. You can choose a particular day of the week that suits you to respond to these e-mails but you MUST reply each week.

Your time commitment will vary each week. Once the first stage is over you will find the time commitment reduces significantly and becomes quite regular.

Some of the tasks in the first phase will require a concentrated effort where you really need to focus. Some of the tasks are very simple and will take just a few minutes. Others may require up to an hour of work. None of the tasks is too onerous. Some you may have been avoiding for longer than you care to admit. I will help you get them done!

If you are in a “total mess” financially, please understand that you arrived at this point after a number of years of practicing the wrong habits. You will need to be prepared to put in an appropriate effort to get yourself out of that mess.

By signing a contract with Handy Investor Pty Ltd I agree that I have read and understood and agree to the Rules of engagement.

Your first TASK will arrive just as soon as I receive your first payment and all signed acceptance of the above conditions disclaimers and Sign up forms.

Privacy Policy: Handy Investor Pty Ltd, As a Spending Planner and Spending Mentor and as members of the Spending Planner’s Institute, I have a firm commitment to respecting and protecting people’s privacy. The following discloses the information gathering and dissemination practices of my service to my clients.

Any information provided by clients will be treated with the utmost of respect for privacy and confidentiality. People’s personal information will not be revealed too any person outside this business unless for the express purpose of providing the service to a client and not without the client’s knowledge and approval.

Data Integrity and Security. We use reasonable and diligent efforts to maintain accurate information on our customers, and have adopted and implemented reasonable industry standard security procedures to protect any such information collected. We constantly monitor our systems, which are protected using industry-standard security measures. Although Handy Investor Pty Ltd will use reasonable efforts to secure network communications and our Sites, we cannot guarantee that the information submitted to, maintained on, or transmitted from our systems will be completely secure.

COLLECTION OF PERSONAL INFORMATION

What We Collect. In some situations you may provide us with your personally identifiable information, which could include your name, street address, telephone number, email address, payment card number, other financial account number(s), photographic image, and any other information we collect about you that by itself is not personally identifiable information but if combined with personally identifiable information could be used to personally identify you.

Personal information will not be sold, rented, given away or shared with anyone not involved in delivering any information, education, goods or services as part of the everyday running of my Handy Investor Pty Ltd business.

Client information stored in the Spending Planner software is encrypted and secured by SSL certification. No important private personal information such as Credit Card details are stored online.
We may use your email and other addresses and contact information for customer support, required notifications, product and policy updates and marketing releases, but we will not use this information for anything else not described in this Policy.

Information We Automatically Collect.

When you access our Sites whether by computer, mobile phone or other device, we automatically collect certain information about your use of our Sites (this information may include without limitation: geographical location, referral source; length of visit; page views;

Refer a Friend. If you choose to use our referral service to tell a friend about our Services, we will ask you for your friend’s name and email address. We will use the information you provide to automatically send your friend an email inviting him or her to visit our Sites. Your friend can opt out of receiving future promotional/marketing messages from us by submitting the opt-out request form.

Access to Customer Information; Updating Customer Information. A customer may (i) access any of their personally identifiable information that we collect and maintain, or (ii) correct, update or delete their personally identifiable information maintained by us, in each case by contacting us by telephone or mail using the contact information provided below. We will try and respond to your request promptly and in all cases within 30 days. To protect customer privacy and security, we reserve the right to take reasonable steps to verify a customer’s identity prior to granting access to or processing changes or corrections to such information. We will retain a customer’s personal information for so long as its account is active or as reasonably needed by us to provide our Services. We may also retain and use such information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Email. We may communicate with a customer through email using the customer’s personal contact information on file in our systems to inform the customer of new products, important industry news or information about Services and upgrades provided by Handy Investor Pty Ltd.

Disclosures to Third Parties – General. We may disclose information collected from a customer to our independent Sub – contractors and business partners who have agreed to (i) hold this information in confidence, and (ii) not use it for any purpose except to carry out the services they are providing for Handy Investor Pty Ltd. Such contractors and business partners include those hosting our Services or other data; managing the functionality of our Services; hosting customer relationship management, marketing automation, customer service and other software platforms on our behalf; processing credit or other payment card payments; collecting delinquent accounts; fulfilling and processing orders; delivering products you have ordered; conducting background checks if you submit an application for employment; assisting with marketing and promotions; and enabling us to send you email.

Disclosures to Third Parties – Specific. Handy Investor Pty Ltd has a number of partner programs designed to maximize our customers’ ability to use our Services and to purchase complementary products and services that may be used in tandem with our Services. We may disclose information collected from a customer to one or more trusted partners for the purpose of such partner(s) providing assistance to the customer in its use of the Services and for the purpose of marketing complementary or value-add products and services to the Customer. In each case such trusted partner will have agreed to (i) hold this information in confidence, and (ii) not use it for any purpose except for the purposes described above.

Disclosures Made by You within Interactive Areas of a Site. If you use a bulletin board, blog, comment or discussion forum or chat room made available on a Site, you should be aware that any personally identifiable information you submit there can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages, and could be potentially searchable through search engines. We are not responsible for the potential misuse by third parties of any personally identifiable information that you choose to submit in these various forums.
Third Party Sites. Our Sites may contain links to third party websites. Please note that the privacy and other policies of any such third party website may differ materially from this Policy. We strongly recommend that customers review the privacy policies of any such third party prior to submitting personally identifiable information. Infusionsoft has no control over and is not responsible for the information practices of other websites, including those to which we may link and those which may link to us.

Use of Widgets. We may provide widgets on our Sites that make it possible to share information on third-party platforms. These widgets do not store your personally identifiable information. Our Sites may also include social media features, such as the Facebook® or Twitter® button and similar widgets and interactive mini-programs that run on our site (each, a Feature). To the extent we use these Features, they may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Social media Features and widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these Features are governed by the privacy statement of the company providing the Feature or widget.

Use of Cookies. When you interact with the Site, we try to make that experience simple and meaningful. When you visit our Site, our web server sends a cookie to your computer. Cookies are files that web browsers place on a computer’s hard drive and are used to indicate whether you have visited the Site previously. The data collected may include how you navigate around a web page and the most commonly clicked links on a specific web page. Certain technical information, such as your browser version and operating system, are also collected. You can configure your browser to accept all cookies, reject all cookies, or notify you when a cookie is set (each browser is different, so check the “Help” menu of your browser to learn how to change your cookie preferences). We use cookies for a number of purposes, including to: access a customer’s account information when a customer logs into a Site, so that we can provide the customer with customized content, keep track of preferences you specify while you are using the Services, and to estimate and report total audience size (unique users) and traffic for our Sites, and to conduct research to improve the content and services of our Sites.

Web Beacons. We may use web beacons (also known as clear GIFs) to access cookies and count users who visit our Sites or open our HTML-formatted email messages. Web beacons are single-pixel graphic files with a unique identifier, similar to cookies. Web beacons are embedded invisibly on web pages and emails and are stored on a user’s hard drive. You can modify your browser settings to control web beacons.

Reviews. We may post customer reviews on our Sites or Services, which may contain personally identifiable information such as your name and/or the city, state, or country in which you live. When submitting your review you are giving us permission to post your review on our Sites or Services. If you post such content, it will be available to other users of the Sites or Services. Your posting may also become public and we cannot prevent such information from being used in a manner that may violate this Policy or the law. If you would like us to remove your name or review from our Sites or Services, you may contact Handy Investor Pty Ltd using the information in the “How to Contact Us” section of this Policy. Note that copies of information that you have updated, modified, or deleted may remain viewable in cached and archived pages of our Sites for a period of time.
